This Privacy Policy (the "Privacy Policy" or "Policy") describes the types of information Amrap, Inc. and its affiliates ("Amrap," "we," "our," or "us") collect and process from and about you.

Except as described in this Privacy Policy, the Policy applies to any and all websites, mobile applications, and any other electronic and/or digital products and/or services that are made available by Amrap and that link to this Policy, and our offline services (collectively, the "Services").

By using the Services, you are agreeing to the practices described in this Policy. If you do not agree to the practices described in this Policy, please do not access or use the Services.

Undefined capitalized terms used herein shall have the meaning set forth in the Amrap Terms of Service.

1. Information We Collect

When you access or use our Services, we may collect information from you. The types of information we collect depend on how you use our Services. Please note that we need certain types of information to provide the Services to you. If you do not provide us with such information, or if you ask us to delete that information, you may no longer be able to access or use certain Services. The information we collect may include data you directly provide to us, data we obtain automatically from your interactions with our Services, and data we obtain from other sources.

Information You Provide Directly to Us

We may collect information directly from you when you register for an account, interact with our AI trainer, subscribe to newsletters, or communicate with us. This may include, but is not limited to:

  • Email address
  • User name
  • Personal data (e.g., date of birth, gender, height, weight, injuries and past surgeries)
  • Your performance data and training preferences
  • Gym details (e.g., name, address, equipment)
  • Your communications and interactions with the AI trainer, via chat or audio
  • Contents of communications with us

Information We Collect Automatically

We and our third-party vendors, including analytics providers, may use cookies, web beacons, and other tracking technologies to collect information about the computers or devices (including mobile devices) you use to access the Services. We may collect and analyze data including but not limited to:

  • Browser type
  • Domain name
  • Access time
  • Referring or exit pages
  • Page views
  • ISP or operating system
  • IP address
  • Unique device identifiers
  • Version of our Services you're using
  • Time spent using the Services
  • Type of device you use
  • How you interact with our app and AI trainer
  • Location data, which may be precise (e.g., GPS, geolocation from Wi-Fi or cell towers) or imprecise (e.g., IP address-based city or state-level data), to help determine where you are training so your coach can adjust your program accordingly

We may also track when and how frequently you access or use the Services, including how you engage with or navigate our site or mobile application.

Information We Collect from Other Sources

We may also collect information about you from other parties, such as third-party platforms like Google or Apple when you sign in through their services.

2. How We Use the Information We Collect

We may use your information for any of the following purposes:

  • Provide and administer the Services, including AI-driven workout recommendations
  • Personalize the Service based on your fitness goals and interactions
  • Improve and optimize our AI trainer and overall user experience, including to train our artificial intelligence/machine learning models
  • Develop new programs and services
  • Communicate with you regarding features, promotions, or updates we believe might be of interest to you, or to communicate with you about changes to our terms, conditions, or policies
  • Engage in other communications with you, such as to respond to your inquiries, comments, feedback, or questions
  • Measure the effectiveness of marketing and promotional activities
  • Detect and prevent fraud, security risks, and misuse of the Services
  • Comply with legal obligations

We may combine the information that we collect from you with data obtained from other sources. We may also aggregate and/or de-identify information collected through the Services and use it for research, development, and marketing purposes.

3. When We Disclose the Information We Collect

We may disclose your information in any of the following circumstances:

  • Affiliates: We may disclose information to our affiliates who assist us in providing the Services.
  • Vendors: We may disclose your information to service providers who perform functions such as payment processing, analytics, and customer support.
  • Legal and Safety Reasons: We may disclose information if required by law or to protect the rights, security, and property of Amrap, our users, and third parties.
  • Third-Party Sign-In: Amrap supports sign-in through third-party platforms such as Google and Apple. When you use these services to sign in, they may share authentication details (e.g., name, email) with Amrap. These platforms have their own privacy policies, for which Amrap is not responsible.
  • Surveys and Promotions: Amrap may conduct voluntary surveys or offer promotions that require personal information. Survey feedback is used to improve the platform, while promotions may require additional data.
  • Analytics: We may share de-identified or aggregated usage data with our analytics provider, PostHog, to help us understand how users interact with the Services and to improve the user experience. PostHog processes this data on our behalf and does not use it for advertising, cross-app tracking, or any purpose unrelated to providing analytics services to Amrap. We do not share your personal information with advertising networks, data brokers, or any third party for the purpose of tracking you across apps or websites.
  • Business Transfers: If Amrap undergoes a merger, acquisition, or asset sale, your information may be transferred to the acquiring entity.

We do not sell your personal information to third parties.

4. Analytics and Third-Party Services

We use the following third-party services to operate and improve the Services:

  • PostHog (analytics): PostHog collects de-identified usage data such as screen views, feature interactions, and device information on our behalf.   • RevenueCat (subscription management): RevenueCat processes subscription and purchase-related data on our behalf to manage in-app purchases and subscriptions. RevenueCat does not use your data for advertising or cross-app tracking. For more information, visit RevenueCat's privacy policy.
  • Firebase Authentication (account authentication): Firebase Authentication, provided by Google, processes authentication credentials (such as email address and sign-in tokens) to securely manage user accounts and sign-in.   • Sentry (error monitoring): Sentry collects diagnostic and crash data (such as error logs, device information, and app state at the time of a crash) to help us identify and fix technical issues. All of the above services act as data processors on our behalf. None of them use your data for advertising, cross-app tracking, or any purpose unrelated to providing their respective services to Amrap.

You have the following rights regarding your information:

  • Access: You may request access to the personal information we hold about you.
  • Profile Information: You can update or delete certain account details through your account settings.

  • Cookies and Analytics: You can opt out of certain tracking by adjusting your browser or device settings.
  • AI Training: You may request that your data not be used for training our AI/machine learning models. We will honor such requests to the extent technically feasible.
  • Data Deletion: You may request that we delete your personal information, subject to legal and operational limitations.

6. Children's Privacy

The Services are not intended for users under 18 years old. If we become aware that a child under 18 has provided us with personal information, we will delete it as required by law.

We implement technical and administrative safeguards to protect your information, including industry-standard encryption for data in transit and at rest. 8. Data Retention

We retain your information for as long as necessary to provide the Services and fulfill the purposes outlined in this Policy. We may also retain certain data for legal compliance or security reasons.

By using the Services, you consent to the transfer and storage of your information in the United States or other locations where Amrap operates, even if these locations have different data protection laws than your jurisdiction.
