Welcome to Amrap! These Terms of Service ("Terms") govern your access and use of Amrap, Inc. ("Amrap," "we," "us," or "our") and our services, including the Amrap website (the "Website"), mobile applications (the "App"), and any other content, tools, or functionality offered through our platform (collectively, the "Services").

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

1. Eligibility & Account Registration

  • To use Amrap, you must be at least 18 years old or the legal age of majority in your jurisdiction. If you are under 18, you may not use our Services.
  • You must create an account to access certain features. You agree to provide accurate and complete information and to update it as needed.
  • You are responsible for safeguarding your account credentials. Any activity occurring under your account is your responsibility.
  • You must not share or transfer your account.

2. Use of Services

  • Amrap provides AI-driven coaching services for fitness training. However, it does not replace professional medical or personal training advice.
  • You agree not to use the Services for any unlawful or prohibited purposes.
  • We may suspend or terminate your account for violations of these Terms.
  • We reserve the right to modify, suspend, or discontinue any part of the Services without notice.

3. Membership & Payment Terms

  • Subscription Plans: Amrap offers monthly subscription plans. The pricing and terms of each plan are available in the App or on our Website.
  • Billing & Renewal: Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date.
  • Cancellation: You may cancel your subscription at any time through your device's subscription settings (e.g., Apple App Store or Google Play Store). Cancellation takes effect at the end of the current billing period, and you will retain access to the Services until that period ends.
  • Refunds: Refunds for purchases made through the Apple App Store or Google Play Store are subject to the respective platform's refund policies. For purchases made directly through our Website, fees paid are non-refundable except where required by law.
  • Payment Processing: We use third-party payment processors, including Apple and Google for in-app purchases. You agree that payments are subject to their respective terms and conditions.

4. User Conduct & Prohibited Activities

By using Amrap, you agree NOT to:
  • Violate any applicable laws or regulations.
  • Distribute, modify, reverse engineer, or exploit any part of the Services.
  • Share harmful, offensive, or illegal content.
  • Interfere with Amrap's operations, servers, or networks.
  • Use AI-generated interactions for fraudulent, deceptive, or unauthorized purposes.

5. Health & Safety Disclaimer

  • Amrap is not a medical service. It provides AI-powered fitness guidance but does not diagnose, treat, or prevent any health conditions.
  • Amrap's AI-generated workout recommendations, including exercise selection, weight suggestions, and programming, may contain errors or may not be appropriate for your individual fitness level, health conditions, or physical limitations. You should always use your own judgment when following any AI-generated guidance.
  • Consult with a healthcare professional before beginning any exercise program.
  • By using Amrap, you acknowledge that physical exercise carries inherent risks, and you assume full responsibility for any injuries or health issues that may result from following the Services' recommendations.

6. Content & Intellectual Property

  • You retain ownership of any content you upload, but by doing so, you grant Amrap a worldwide, non-exclusive, royalty-free license to use, display, and distribute that content solely in connection with providing and improving the Services. This license terminates when you delete your content or your account, except to the extent that copies of the content have been incorporated into de-identified or aggregated datasets used for improving our Services.
  • Amrap's trademarks, logos, software, and other proprietary content are protected by law. You may not use them without prior written permission.

7. Privacy & Data Usage

  • Your privacy is important to us. Please review our Privacy Policy for details on how we collect, use, and protect your personal data.
  • You consent to receive emails and push notifications related to your account and Amrap's offerings.

8. Limitation of Liability & Disclaimers

  • TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU EXPRESSLY UNDERSTAND AND AGREE THAT AMRAP SHALL NOT BE LIABLE FOR ANY INJURY YOU MAY SUSTAIN OR ANY DIRECT, INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL, PUNITIVE OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE AMRAP PLATFORM OR ANY FEATURES, INFORMATION OR MATERIALS PROVIDED ON THE AMRAP PLATFORM, OR COMMUNICATIONS RELATED TO THE AMRAP PLATFORM, EVEN IF AMRAP HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
  • TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL AMRAP'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, CLAIMS, AND CAUSES OF ACTION (WHETHER IN CONTRACT, TORT (INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE) OR OTHERWISE) EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING OR USING THE AMRAP PLATFORM.

9. Dispute Resolution & Arbitration

  • Binding Arbitration: Any disputes will be resolved through binding arbitration rather than court proceedings, except for claims that qualify for small claims court.
  • No Class Actions: You agree to resolve disputes individually and not as part of a class action.
  • Governing Law: These Terms are governed by the laws of the State of New York, USA.
  • Indemnification: You agree to indemnify, defend, and hold harmless Amrap, Inc., its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

10. Termination

  • We may suspend or terminate your access to the Services if you violate these Terms.
  • Termination of your account does not relieve you of payment obligations for any accrued fees.

11. Changes to These Terms

  • We may update these Terms from time to time. If we make significant changes, we will notify you through the App or Website.
  • Continued use of the Services after changes take effect means you accept the revised Terms.
